Can a father take custody of the son if the mother has is going to jail even if the mother wants her mom to keep him while she does her jail time.the mother has custody

Here's your answer: go to Legal Services and get a low-cost attorney to handle your case. Don't go bargain basement on your child's custody case.
Yes, fathers can be awarded custody - IF he shows he is capable of taking care of the child.
If the grandmother already has custody, then the court probably won't change this.
How old is the child? Can YOU take care of a baby?
How about just spending a lot of time with him?

Ii is after all your child's custody. do not settle for less. talk to a professional....
