Record Downloaded Program on CD?

I gave my old Agfa scanner to a relative but he has Windows XP and the CD that came with the scanner was for Windows ME. He does not have internet yet. Can I download the XP version of the program from the net and record it on a CD and give it to him so he can install the scanner?
