The news stories over this issue had not address any of the subjects concerning the cyclist that I would consider of important.

Such as whether he was under the influence of alcohol or drugs himself and if he had lights on as the law demand.

Exactly. So all this stuff is in your head, the only fact is that a drunk driver killed a cyclist.
I wonder if the cyclist, going in the opposite direction
crossed the line and hit an innocent driver, on his way home,
who got drunk to calm his nerves after Barry crashed into him.

The cyclist might have been disoriented
BEFORE he hit Tom Swift.

He might have been abducted by aliens and suffering from time loss.

@ehBeth,
LOL being both a long distant cyclist and a driver I had seen cyclists weave in front of cars more then once.

So yes the actions of a cyclist can indeed cause an accident that have nothing to do with the car driver.

While that might be true, you seem to be overlooking the fact that Swift is being held legally accountable for his behavior behind the wheel of his car.

Well, if the aliens [Mexicans??] did that, then there'd have been no collision, right ??

Did this collision result from the derelictions of aliens??

Yes; either that, or
Barry hit Tom 's car from some different angle,
if thay were proceeding in different directions.

It is relevant to prove that this is among the POSSIBILITIES
of what misfortune might have afflicted the parties at the time & place of occurrence.

@OmSigDAVID,
Yes, but there's a huge difference between considering all possibilities and saying something must have happened because BillRM said it happened.

My question concerns the appearance
of what Bill is "entertaining". Can u justifiably RELY upon that appearance ??

I think he was mad because Tom did not invite him to the bar.
