But that could be used either of those two ways by the prosecution. "Duty of care" can involve cover during absence. It certainly does in the case of children.

If the defendant did not administer the drugs,
but rather the decedent took control of the situation,
then I fail to see how the M.D. can be liable; i.e., he did not DO it.

@OmSigDAVID,
It has been brought up (according to our Austin TX Statesman, that Michael Jackson may have injected himself. However he may have got hold of the anesthetic is anybody's guess. Seems like gross negligence by the doctor.

HOW does it seem negligent?
Decedent brought it on himself.
He probably KNEW the potential risks.
He was not new to use of those drugs.

It seems to ME,
that defendant was free of any negligence.
