An assistant chief immigration judge is typically an attorney who has many years of experience working in the area of immigration law. The duties of this type of judge are both administrative and judicial in nature.

Authority

1. The Office of the Chief Immigration Judge falls under the jurisdiction of the United States Department of Justice. Immigration proceedings are administrative in nature. An administrative hearing or procedure takes place outside of the traditional judicial process. Administrative hearings take place before a judge that has been granted the authority to preside over and decide specific matters--in this case immigration and naturalization matters.

Structure

2. The chief immigration judge has more than 200 judges that work under her throughout the nation's immigration courts. The attorney general of the United States appoints the chief immigration judge, and the director then appoints the assistant chief immigration judges and deputy immigration judges.

Assisting the Chief

3. The assistant chief immigration judge is responsible for helping the chief immigration judge carry out his duties. Those duties include issuing instructions and policies for the deputies, providing training and evaluating employees.

Acting as Judge

4. An assistant chief immigration judge is required to adjudicate immigration and naturalization cases. Typically, she will be required to preside over removal proceedings. A removal proceeding is used to determine whether a person who is here from a foreign country should be allowed to remain here or be deported back to his home country.
