To my mind, based upon the facts as undisputed by defendant, this was
malicious murder.
If someone aims at a car, trying to shoot the people therein
and he succeeds, in circumstances wherein that car is leaving,
this is indefensible. The facts show that he wanted to shoot them,
he shot at them and he hit his target = malicious murder, unprovoked.
If there is any reason against inflicting capital punishment,
that 's more than I can discern.
