My sister is a creditor in a current bankruptcy. She had a personnel relationship with this person and got a judgement against him in small claims court. He and his wife have file bankruptcy Chapter 7. The bankruptcy also names 16 credit card companies all cards have charges on them from in the range of 2000.00 to 21,000.00 dollars. I'm 100% sure that these two people charged on these credit cards knowing that they where going to file bankruptcy. I would like to know if anyone can advise me on how I can proof this ?
Wanda, I'm sure all 16 Credit Card Companies are going to try to prove that the couple maxed out the cards without any intention of paying. They have resources not available to your sister.
One problem with Small Claims Court is that there is no way to force payment of money owed. Obviously, these creditors don't mind owing money. They lack shame.
