HAS ANYONE ON A2K EVER FILED A MEDICAL MALPRACTICE SUIT?

I have a situation wherein the GP I am using perscribed a beta block for for my high blood pressure in spite of the fact that I am COPD. The medication caused my heart rate to drop to 35-40, and induced a bary (bari?) cardia condition which affected the amount of air going to the lungs and heart, dizziness. This is the third high blood pressure med he has had me on that has caused me extreme reactions.

Now, I am going for female surgery on Nov. 4 in Waimea. Beause of the mistake he made, and he admits it, the medical team in Waimea has been wonderful and hopefully I will be cleared for surgery. True cardi-cardia generallyleads to the installation of a pace maker.

I feel that I am a victim of a medical sweatshop and pill factory. The doctors office consists of himself, a nurse that had been fired from a hospital because of drug addition and theft of drugs, a verbally abusive bookkeeper and a receptionist. The doctor has seven thousand patients.

I feel I have grounds for a malpractice suit.

I've never filed a malpractice and I'm not an advocate of doing so in general, but I know things you should consider. I DO think you should file a complaint against this doctor with your state's Board of Medicine no matter what else you decide. It's a good place to find out if a doctor has a rap sheet or not. If you want to pursue a malpractice suit you will need to find a lawyer who specializes in it - there are plenty of them, but talent varies greatly. You should be prepared to face attorneys from the doctor's insurance company and they are very good at making patients look responsible for the injury done. The fact that you seem to know a lot of negative things about this doctor's practice and you allowed him to give you medication three times with serious reactions and didn't get a second opinion is going to be thrown at you in court. Be prepared to explain in great detail why you continued to use this doctor when your treatment seemed to worsen your condition.Every little detail of your medical and mental history will be examined and presented to the jury. You will be on trial as much as the doctor. Also remember that nowadays juries tend to side with doctors because they know lawsuits make their own health costs go up. I also doubt any of your current doctors will want to testify in your defense and against the doctor in question. Doctors don't like challenging their fellow medical comrades because they always think "there but for the grace of God go I". I wish you good luck and better health no matter what road you take.

Thank you Green Witch.

My surgeon's office called today and surgery has been cancelled which was at my request and they are sending me to a heart specialist to make sure surgery will be safe.

Evidently Doc has made some mistakes and there is a possibility of a class action suit envolving a lot of folks.

I have four doctors in my immediate family to guide me. They are unhappy with what he did. I just have to be careful as how to proceed.

My former doctor is a mainlander and not respected by the Asian medical community.

I am still looking for input on this if anyone knows anyone who has filed a malpractice case and either won or lost. Love to know the details.
