My foreclosure attorney lied to me, and didn't tell me we had 28 days to appeal in foreclosure court. After the court she didn't even called me, I had to call her for 3 days to find out the outcome. I asked if we can appeal, and she said: NO, you can't appeal in this kind of case (foreclosure). I left it like she said. Just today I contacted my mortgage company layer, and they said that we didn't appeal and they had to put our house for sheriff's sale! We want to keep the house and work on loan modifacation. Sheriff's sale is in few weeks. What do I do!!! please help!
An attorney lied?
I don't believe it.
@chai2,
;-) You're funny, but it's really stresful for me.
All I can suggest is find a new lawyer. The new lawyer should be able to tell you how to rectify the mistakes made by the old one.
@ebrown p,
Depending on how much time is allowed for appeal. If the time has expired, I believe it is final. If the OP can prove the attorney lied, there might be recourse against the attorney, but I would not expect that an appeal would be allowed.
@Zakopane25,
Call you State Attorney General's office and ask if there is anything you can do about the foreclosure appeal based on poor legal advice. If you have proof the attorney lied you can contact your state's bar and file a complaint.
I just heard about an incident in my neighborhood where a homeowner was able to buy back his house at the bank auction for less than he originally owed on his mortgage when he lost the house. I guess anything can happen. Good luck.
Your problem was that you went to the wrong people (a lawyer and the mortgage company) to find a workable solution to this mess.
Find one of the MANY non profit agencies helping homeowners and see if something can be done.
