I contested a foreclosure, a judgement was rendered but this is what it said: IT IS ORDERED AND ADJUDGED THAT THE PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT IS GRANTED, SEE JUDGMENT. THE COURT FINDS THAT PLAINTIFF LAWFULLY POSSESSED THE PREMISES, AND THE DEFENDANT UNLAWFULLY DETAINED THE SAME. IT IS FURTHER ORDERED, ADJUDGED AND DECREED THAT PLAINTIFF HAVE RESTITUTION OF THE PREMISES FOUND TO HAVE BEEN UNLAWFULLY DETAINED TO-WIT: , ST. LOUIS MO, 63137. COSTS TAXED TO PLAINTIFF. IT IS FURTHER ORDERED ADJUDGED AND DECREED THAT PLAINTIFF, BE AWARDED AGAINST THE DEFENDANTS THE SUM OF $100.00, DOUBLE THE SUM FOUND FOR PLAINTIFF'S DAMAGES: AND ALSO THE RATE OF $1,114.56 PER MONTH FOR WHICH IS DOUBLE THE SUM FOUND PER MONTH FOR RENTS AND PROFITS FROM FEBRUARY 15, 2008 TO THE DATE OF JUDGMENT AND UNTIL RESTITUTION OF POSSESSION IS MADE. SO ORDERED
I also have to appear in court on 9/9/08 for EXAMINATION OF JUDGMENT DEBTOR not sure what that means either
I'm no expert, but it looks like very good news for you to me!!
It is good news. Make sure to go to court on time and dress nicely (professionally).
Uh, I'm no expert on foreclosure matters, but wouldn't the mortgage holder be the plaintiff in a case like this? If so, then this is hardly good news for kathynes1. And I'm guessing that she would have been aware that she had filed a motion for summary judgment if she was the one who did that.
On the first page, kathynes1, it should say who is the plaintiff and who is the defendant. So which one are you?
Duh on my part. Joe's right of course.
