I have to write an essay about the American legal system. My thesis is:

'Contingency fees do not increase litigation'.

It would be great if you could give me your opinion or any information about this subject.

IMO, it works both ways, so that one aspect of the issue will nullify the other, so litigation is not increased.

For instance, one might think that a person would file a lawsuit more easily when he knows that it would not cost him anything unless he is on the winning end of the case. On the other hand, a smart attorney knows the probabilities, and will not take on a case that he has little chance of winning, and getting a fee that he desires.
