I had a bit of trouble with the state. They took my kids. I tried to kill myself and they gave me two choices; sign over my rights and have an open adoption or go to court, get my rights terminated and not see my kids at all. So, I signed over my rights but I feel I didn't have a choice and I want my kids back. They are not doing well in foster homes and I feel they would not be having these problems if they were with me. I don't know what to do anymore. Talked to a lawyer and the lawyer said I have no hope of getting my kids back. I feel there is a legal loop whole I can use but don't know where to find it. Crying or Very sad

Well, you don't even say if you've attempted to get help. Attempting suicide is something any court, in any state, is going to take seriously in terms of showing mental stability (or a lack thereof). Getting counseling, with proof that you're actually going rather than saying you're thinking of going, will be helpful. There are no guarantees.

I'm not an expert, but it seems to me that if your kids were put into foster care there should be a caseworker keeping track of them. Have you talked to this case workers?

In order to regain custody of your children, you have to prove that you have changed and that your home is a safe place for them. Was counseling recommended? What about alcohol/drug rehab? Do you have your GED? A steady job? Can you afford to pay housing costs for a family of three?

There are no "legal loopholes" here. You must prove to the courts that you can give your kids a satisfactory home.

Obviously you miss them terribly and you are in considerable emotional pain. Even so, you have to pull yourself together and make major changes in your lifestyle.

Just out of curiousity, why did you ask about alcohol & drug rehab? There is nothing in the original post mentioning that Confused

When children are removed from a parent's home it is because the social workers think they are in danger.

One of the most common causes of child abuse/neglect is misuse of drugs and/or alcohol. Drugs and alcohol can be responsible for generations of misery.

I could be very wrong in my assumptions--but there is some reason that the children are in foster care.
