Doesn't judicial activism by definition introduce new rights rather than protect existing ones?

I think it is more that the judges decide that we have always had certain rights, and so they change laws (or reinterpret them) to give the rights they feel we have been denied. I am not saying they are not full of crap, but I think that is more of the jist than just introducing new rights.

amazing topic, i had it at camp and hated it at first but once you get into it it's amazing Smile lol



link wise i just suggest using the constitution and court cases
