Suppose an American "smart" bomb is deflected from a legitimate target by an Iraqi jamming device purchased from Russia. Who is guilty of a "war crime", and how should blame be apportioned?

There would be no war crime, but the victors get to determine tricky stuff like guilt so if anyone is prosecuted it will be the Iraqis.
