Is it legal to establish a scholarship at a university open only to members of one's own ethnic group?

The reason that I am asking is that I read that in 2012, the family of U.S. Secretary of Transportation Elaine Chao donated $40 million to Harvard Business School for scholarships for students of Chinese heritage.

Donations are often "restricted", that is, are accepted with terms or stipulations.

Since no public funding is being used for scholarships for this small target audience, there's no legal issue.
