Apartment Lease

Hi,

My roommate and I have a leave ending March 31. We are both on the lease. I found the place online and then found a roommate a few months later to occupy the 2nd bedroom. I want to have him move out at the end of our lease and find a new roommate. Do I have any leverage since I found the place and paid the deposit?

Unless it was written into the lease agreement, or an agreement between the two of you was also signed by both of you, probably not.

Probably not, since he's also on the lease. You could ask him if he would consider moving, if he does, you got it made - if he doesn't you could ask him to pay half of the deposit amount, but that's about it.

Or you speak to your landlord and ask to be the sole renter as of April 1.

Then its up to the landlord who should be very careful how he announces his decision. Who signed first? Who initiated the contract with the landlord? What is the nature of the breach between the two lessees? Late payments, unfulfilled promises of payment or obligation, ruptured relationship?
