Causing death by careless driving can be punished by up to five years imprisonment.

Should it be "5 years' imprisonment" instead?

No. I would only use quotation marks if the driver were not actually in prison.

Yes. It's replacing 'of'.

Five years' imprisonment = five years OF imprisonment.
