If some one shoots your dog should you have the legal right to shoot them regardless of the conditions and or circumstances ?

You mean, like shoots your dog after it bites you or your children? Kills your chickens. Maybe they shoot the dog because they don't know who it belongs to.

No. You should not have the right to shoot a human being unless there is a immediate danger to yourself of another human being, or you are a combatant in a war.

First, killing human beings for vengeance is morally wrong and against the law in civilized countries even in retaliation for murdering a human.

Second, human life is far more valuable than a dog's life.

In many states, pets are considered property. So? No. There is no legal justification that would allow you to shoot someone who merely shot your dog.

Vengeance is also frowned upon in most places that rely on the rule of law. If someone shoots your dog (or commits any other crime), file a police report and let the law resolve the issue.

On the other hand...

If your dog ever shoots someone, he will probably have to be put down.

No - you have no legal right to shoot someone that has shot a family member either - unless of course it is during the crime where you are doing so to protect yourself or someone else.

Instead you report the crime and ideally the court system finds them guilty and they serve an appropriate sentence.

You shooting them in return just causes you to now have committed a crime in return.

Not regardless of the conditions and or circumstances, but in Texas, Penal Code - PENAL § 9.42. Deadly Force to Protect Property states:

Quote:

A person is justified in using deadly force against another to protect land or tangible, movable property:

(1) if he would be justified in using force against the other under Section 9.41 ;  and

(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime;  or

(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property;  and

(3) he reasonably believes that:

(A) the land or property cannot be protected or recovered by any other means;  or

(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.
