IRS REFUND CHECK

My husband passed away in April 2010. I just had a CPA file our tax return; married joint as usual. He said I am due a refund. will the check be titled to my husband, myself, his estate or both of us. There really wasn't an "estate" everything was either joint or in my name only. In our Will everything was suppose to go to the surviving spouse. In the past when we received a refund it was always joint. If it is joint this time will I have a problem depositing the check?, Thanks for Your help

You will be filing as the surviving spouse.

But if he had income, then the filing will be in both names, and so would the refund check.

(I deposited our refund in the bank where everyone knew my husband had died. I just signed his name. It was for a small amount. No one said a thing.)
