Disability Discrimination by a Restaurant called KJ's American Grille in Meridian Idaho. My brother and I are being discriminated against due to our blood disorder which is similar to hemophilia, and I have been on social security disability for years due to it. The manager and owner have both made it clear that we are not welcome if we continue to have nosebleeds and leave blood on a napkin or on their dishware, etc. and they demand that we leave no evidence of blood at their restaurant. They have no right to refuse us service as we are federally protected under the Americans with Disabilities Act. The owner claims that my brother and I pose a biohazard health and safety concern to their employees and their other customers which is untrue; due to our condition we have weak veins that easily break, and we do not have any disease or infections nor are we contagious at all. The owner claims that she has certain policies in place suggesting that she has the right to refuse us service. Despite what many believe a business does not have the right to refuse service to anyone, that only applies in certain situations. The owner also claims that according to the CDC she has the right to refuse service to us, which is a lie, we would have to be so sick and contagious for the CDC to give her permission to refuse service to us and if we were that sick, we would most likely be in isolation at some hospital.
The owner does not have the right to refuse service to any disabled person even if they have AIDS, HIV or hepatitis ,etc and they certainly cannot ask any customer to clean up their own areas as if they work for them.
There are state and federal laws that prohibit their discriminatory practices and her so called policies cannot supersede state and federal law.
