Is it illegal for a cop to wait 20-30 minutes after a stop to give a breathalyzer test? I got caught in a check point about 20 seconds after finishing a double shot, didnt have time to get a piece of gum in my mouth, it happened that fast so i told the truth. Dowl hill from there

No, it's not illegal. By the way, gum doesn't hide the smell of alcohol....unless the other person is drunk, and frankly drunks aren't usually interested in your breath because they can't maintain the interest.

One of the first things a police officer needs to check before breathalising you is to find out when you last had a drink.

If you have only just had a drink it will spike the results giving a positive. Twenty minutes later when it's been absorbed into your bloodstream the results will be more accurate.

That is why once someone fails a breathaliser test they are taken to the station and given a blood or urine test which is more accurate.

That is not the issue here. You were unfit to drive, you could have killed someone driving in that condition, and for all you know the only reason you weren't in an accident that night was because you were stopped by the police.

Instead of complaining about being caught for your irresponsible, criminal behaviour you should be thanking the police for taking you off the road.

Don't drink and drive.

Once I was driving back home after having had a drink, I hadn't had a lot to drink and was under the limit, but I had had a drink.

I was driving down a narrow, country lane, it was dark.

When I turned a corner there was someone all dressed in black with his back to me walking down the middle of the road.

Fortunately I managed to stop in time.

Now, if an accident had happened he would have been more to blame than me. I was under the legal limit, but if I had hit him and it had gone to court the fact that I had a drink would have been a factor.

As it was I just stopped in time, and if I'd had another drink I would probably have killed him.

After that I decided not to drink anything at all if I'm driving. If I to to a craft fair where local brwers are giving out tiny tastes of their wines and spirits, I won't have that.

Don't get me wrong, I like a drink, I still drink, but I don't drive afterwards.

That's an urban legend. Chewing gum DOESN'T block breathalyzer tests from detecting alcohol in your breath.

The longer they wait, the better the chance you'd pass the breathalyzer test. Why would you complain?

You ended up confessing before the actual breathalyzer test? The cop was probably trying to give you a break ... hence the 20 to 30 minutes pause before administering the test and well... since you confessed, he legally was obliged to follow through with the arrest.

Finally? That you posted here instead of getting a proper defense attorney? Yes. It is ALL DOWN HILL FROM HERE.
