Long story short, I was accused of assault, but, in actuality, I was the one assaulted. When I was arrested, it was a big scene so I was also charged with trespassing, resisting arrest, and disorderly conduct. I was wondering if there is any case law out there that helps me out. The prosecution has zero evidence of me assaulting anybody because it never happened. Because I made a big scene upon my arrest and I pissed off the arresting officers, they hit me with these extra charges that are, actually, very hard to dispute by definition of the law. What I'm wondering is this: if the entire arrest was predicated on a false allegation for which the state cannot prove, will the other charges be dropped with it? Does the false allegation negate my righteous behavior upon arrest? Damn right I was pissed and giving the cops and bystanders Hell. I am innocent and you are interrupting my life and taking my freedom. **** yes I'm pissed.
