U.S. seeks extradition of Canadian pot crusader

Vancouver police armed with a search warrant have raided a pot-seed store run by Marc Emery, the head of the B.C. Marijuana Party.

The warrant was executed on behalf of the U.S. government.

Emery himself was taken into custody in Halifax.

The document alleges a conspiracy to produce marijuana and distribute seeds as well as alleging money laundering.

"Their activities resulted in the growing of tens of thousands of marijuana plants in America. He was involved, allegedly, in an illegal distribution of marijuana in this country [U.S.]. He is a drug dealer," assistant U.S. attorney Jeff Sullivan told CBC News.

Vancouver police officers carried out the raid. As a result Emery is out of business.

Chris Bennett, who works for Emery and was at his office when it was raided, says he's angry an American warrant was executed by a Canadian police force.

"They're taking him down to face charges in the United States of America. And sentences in America for this kind of thing is so much harsher that one would face in Canada," said Bennett.

U.S. officials allege that Emery has sold as much as $3 million in seeds.

American officials are seeking Emery's extradition, which could take six months to a year.

Most likely the warrant was issued in a BC court. I don't think an American warrant would have jurisdiction outside of the US. I think what he's upset about is that someone outside the US can be extradited and charged in the US even though they weren't actually within the US. I think though it's likely to be valid as the conspiracy was effectively completed in the US. Interesting case to watch though.

VANCOUVER/CKNW(AM980) - The leader of BC's Marijuana Party could be extradited to the U-S to face drug charges.

Drug Enforcement Agents in Seattle claim Marc Emery's been making up to three million dollars a year by selling pot seeds over the internet.
The store in the 300-block of West Hastings was raided shortly before 11 this Friday morning, but Emery was arrested in Halifax where he was attending a conference.

He and two other people, Michelle Rainey-Fenkarek and Gregory Williams, are accused of conspiracy to manufacture marijuana, conspiracy to distribute seeds, and conspiracy to engage in money laundering.

Emery's supporters quickly gathered outside the BC Marijuana Party office in Vancouver to protest the raid executed on behalf of the U-S Government.

Four protesters were arrested when they tried to keep police from removing boxes of evidence from the building, but they were released without any charges being laid against them.

That's going to be a really interesting case - depending on the details. I presume he has been sending seeds to buyers in the US or something.
