Failure to protect order

My kids were taken a couple of days ago by CPS because they said that the mother was failing to protect them because we live together with the kids and I had a domestic violence case against me. But my kids Are well taken care of there honer role students and we don't even spank our kids the reason they took them was because they could. But we go to court Tuesday and we got a lawyer and he said to put a restraining order on me to show that we are willing to do whatever it takes to get my kids back. But I just wanted to know the chances of my kids coming back on Tuesday. Because once again they were never taken because they were in danger it was they say me and the mother argue in front of the kids but I got a hotel and she put the restraining order on me to show she took the steps to protect them so what do you think the chances are of them being returned back home on the justify heading.

OK, what was the basis for the restraining order. It couldn't just be that 2 adults were arguing about what to watch on television. Did someone scream threats, were things thrown or broken, was someone drunk or on drugs???

And before Max weighs in, it's entirely possible the mother was the one who was dangerous......

Your chances of prevailing in court are pretty much the textbook definition of legal advice. This is a question for your lawyer.
