Importing Nike from China

I've found myself in a bit of a pickle.

I have access to a wholesale trading company in China, they deal directly with the Nike Manufacturer and for a bulk wholesale price/order I can get the shoes delivered to my door. I did a lot of research and a successful internet company on the west coast imports Nike shoes and sells them without a lisencing agreement from Nike, and they told me that as long as I get the shoes from a 3rd Party Distributor I'm alright.

However, DHL called me the other day to tell me that my shoes were stuck in Sanfransisco customs because they are Nike shoes and violate trademark laws.

Who's right, who's wrong and what can I do to get these shoes on my doorstep from China on a regular basis?

Any help or suggestions would be completely appreciated. I'm a college kid who thought he had figured out a way to make some extra (legitimate) dollars. Tell me if I was wrong. Thank you.
