I got a second DUI in Colorado recently. My first DUI was in Kansas 10 years ago. So turns out on my criminal history report the colorado DA pulled , it actually says I was charged in Kansas with a "conspiracy to drive under the influence of alcohol." So is that a different charge than an actual DUI?. Now with this recent DUI I'm thinking they can't charge me As a second DUI offense since the first was technically a conspiracy to dive under the influence and not actually DUI. Do I have a case here to disputed that and say theybcn only charge me as a first offense dui ??

Conspiracy = intention.
Were you caught being drunk with the intention to drive?
Best to ask a lawyer how this all adds up to the current situation.
