I was sent a form from my future employer regarding screening of my past. The job I am about to start is the one of “IT developer”. In this form there is a specific field stating "Have you been involved as a suspect of a criminal offence in the Netherlands or another country in the past 8 years?(Also state traffic offences. Traffic violations do not have to be stated.)"
I was accused of shoplifting 1 year ago and paid a fine of 180 euros, which was sent to me my mail. Do i have to refer to this case? I consider this information personal data which should not be disclosed. How should i act?

@adriano100,
Unless you shoplifted while driving, it's not a traffic violation.

Unless Dutch law says otherwise, you've got to disclose it.

But check with a Dutch lawyer, because entering a plea down to a fine might not be considered being a 'suspect in a criminal offense', and the I assume small fine might also not qualify specifically as a criminal offense. Also find out if this is a reasonable question for an employer to ask or if any of your country's privacy or other laws prohibit it.

@adriano100,
Yeah, I would talk to a lawyer too.

And, I would want to know the consequences of lying... if they weren't bad enough I might just omit the offence. For an IT position, this offence shouldn't be any of their business.
