The 1968 movie 'Night Of The Living Dead' is in the Public Domain. I would like to know if one could remake their own version of that 1968 movie without fear of reprisal?
Also, could one legitimately use the same title, or would it need to be changed?
@shiddy81,
While Plagiarism Today claims it's in the public domain (see:
https://www.plagiarismtoday.com/2016/10/25/why-night-of-the-living-dead-is-public-domain/), I would consult with a competent copyright attorney if I were you. Please don't cherry pick advice over the internet.
@shiddy81,
While that particular movie might be in public domain, George Romero still owns the
Living Dead franchise which already includes the
Night of the Living Dead (1990) remake.
You will likely get in trouble because of that copyright coverage.
