and not the psychiatrists?

Does "and not the psychiatrists" refer to "(the law is) not going to define what the psychiatrists are"?

Context:

An idiot and an insane person cannot commit a crime, the law declares, but adds in effect, "The law is going to define what an idiot or an insane person is, however, and not the psychiatrists."

@oristarA,
No.

It means that the psychiatrists are not going to define what an idiot or an insane person is.

"The law is going to define what an idiot or an insane person is, however, and not the psychiatrists."

The "and" is superfluous and is probably what lead to the ambiguity.

The law, and not the psychiatrists, are going to decide who the idiots and insane people are.

But the profession of a psychiatrist is to diagnose who's insane and then treat them...

Only if and when the law permits them to. In fact, in many jurisdictions, qualified psychiatrists are required to give evidence in court to help decide if someone who has committed a crime should be considered insane.

You have no argument from me. I'm just interpreting the text you've provided.
