Legal Question...Just For Discussion

Let's say I drive by an accident and someone I really dislike is pinned under a vehicle. They say"Please help me", and I answer "Sorry " and go on. The person dies. Probably if I'd called 911 they'd have lived but I chose not to. Am I guilty of second degree murder or some other lesser charge?

Everytime I post something... no matter what it is or the subject...someone immediately votes it down. If I were an immature asshole like this person I might say something really childish like "Why don't you blow me...your wife and daughter really enjoy doing it", but I'm too mature for that. Very Happy

Depends on what state you're in. Some states make it a crime for a bystander to fail to render assistance in certain cases. For example, Washington says that, if you witness someone being injured in a crime and do nothing about it, you're guilty of a misdemeanor. I think a few other states have similar laws. Most, however, do not, and the general rule in Anglo-American law has always been that a bystander has no positive duty to render aid or assistance to an injured person.

Apparently not.

Duty to rescue rarely applies in the US unlike in many other countries:

Although I like your enthusiasm, I think many topics get voted down by people who just aren't interested in the topic, without regard for who posted the thread. Most of the word game threads get this treatment.

But on the other hand, maybe you're right and they just think you're an asshole. Laughing

I wouldn't jump to a conclusion Tico except that it happens right away with 100% of what I post, no matter the subject, so I think I'm right. Obviously there are those who think I'm an asshole, which I can be. And more. Twisted Evil

Yeh you are convicted on humanity ground also but never worry consult a lawyer and he may brief you the charge you may be imposed to.

I think you are not entitle for that murder.Because there may be any other reason that you reject that person.And there is no fault of you because you didn't strike that person with your vehicle.But on the basis of humanity may be they charge you some fine.
