My ex husband is taking me back to court to ask for 50/50 custody of our son. He claims that our son needs to develop a close bond with his new siblings at his fathers home. His father remarried and had 3 new children. Is he able to get more time based on that?

No its not, but there is so much more to the story, I was just curious is there was any legal precedence that the courts would favor that decision. He already claimed that the school our son is enrolled in falls way below the school near his home, he claims that we live in a bad neighborhood based off a crime map he viewed via Internet. We have been back nd forth but he has admitted that he only wants more time so he doesn't have to pay child support.

I was just seeing if anyone else was or has gone through the same thing, Im not going to take advice straight to court

Even if it was exactly the same situation, with a different judge, jurisdiction, state or country the result could be the exact opposite.

Get a lawyer.

In an issue as important as child custody, I would not be seeking advice from strangers. I just might be your ex and who knows what my motives are. Get to a family practice lawyer immediately. You generally can speak to one free for the first visit. Do it now.

Free advice from strangers on the internet is worth every penny you paid for it. And sometimes, a great deal less.

EDIT: he's already started proceedings and you haven't retained representation? This could turn out badly, GO SEEK LEGAL ADVICE IMMEDIATELY!!!!
