Soon after I received my SS back pay in Nov 2019, Vi requested I pay $200 a month for Christians car insurance, just for a few months until his insurance rate drops. At the time I felt comfortable financially and agreed I would help her out. I did this for two months but she would never tell me when his insurance rates were going to drop, why they would drop, or show me her insurance quote and bill. I decided to stop giving her $200 a month for car insurance unless there was a record of it through the clearinghouse. That’s when Vi stopped communicating with me.
I’ve been divorced since 2008 and have been making child support payments since then (current)
Income of Vi is 68k
My income 32k (disabled veteran)
The current court ordered child support is $357 a month and I continue to pay $357 a month.
If her payment goes to $800
A month from SS and covers my child support as the court has said it would, Vi would see a 124% increase in the money she receives and I would see 100% reduction in the money I pay to her out of pocket.
When she gets her back pay for Christians social security she will have received $1157 a month going back 2 plus years. A 224% increase from the court ordered child support of $357 during those 29 months. I will see a 0% decrease unless I am paid back the $377 for all those months covered by the $800 SS payment back pay. It was made clear by the court that the $800 from SS for my child will cover the child support payment.
Vi is demanding an additional payment of $200 to bring the total of money she would receive to $1357 a month. She says the extra $200 would be payment to her for Christians car insurance. A car that she paid for and bought brand new without my knowledge and said it’s Christians car (however, the title is in her name). She will not let our son drive to see me until I pay for his car insurance. The distance between us is a 40 mile round trip. I offered to make an additional $200 payment a month back in Feb 2020, through the clearinghouse if money was tight for her now, to pick up the slack until she receives her back pay and monthly payments for Christian through SS. However, I wanted to have a record of payment through the clearinghouse. She said that would be unacceptable. She wants the payment to go directly to her.
If I were to give her an extra $200 a month she would now see a 280% increase from the court ordered child support of $357 and I would see a 56% increase in my payments to her.
An additional reason she gave as to why Christian cannot drive to come see me is because I don’t work, and According to her, I don’t do anything all day, (may I remind you I’m disabled) She said its only fair that I be inconvenienced.
@Saasam,
What does your lawyer have to say about all of this?
