Can a employer sharing their household amenities with multiple employees, blame an employee(s) for plumbing issues, and withold all of their pay ($450) to pay for a plumber? Also, this accusation is... well, just that, an accusation. When in reality there's no way to blame a certain employee, besides of ovulating age females that have worked there up to 6 months ago. That's been a lot, and I've only been there 2 months. What do I do? Please help.

@Shangibs6581,
Not sure I understand the situation, but it will surely depend on location.

The short answer is that in New Mexico, USA, an employer can only withhold pay with written permission of the employee - except for mandatory deductions such as FIT and payroll taxes. Refusing such a withholding might end up in termination of employment, of course.

If an employer is sharing his or her home with his employees, that certainly sounds odd, but not especially relevant to the question.

@roger,
It's the amenities that they're sharing, not the home. I would guess that it's a business being run from the owners house and the staff have the use of the bathroom and so on.

I don't understand the bit about the ovulating females.

@cherrie,
That clarifies a lot.

Could there be a problem with what's being flushed down the toilet.

Sorry I guess I did leave some details out originally...

Okay, so I've been working there for the past 2.5 months as a horse groom on a farm (at my boss's house/property). I worked 5, sometimes 6 days a week and average around 55-60 hours per week usually. Hours are handwritten in a notebook, we get paid every 2 weeks, which would make this Friday payday, and I (everyone) gets paid cash. What happened was she randomly fires me and the rider (also a female/ the only other female) last Friday... mmmkay, well the boss's basement (office) bathroom is also our employee bathroom. So this bathroom has been stopping up for the past few weeks, however my husband who has worked there for over a year, says that in the time he's been there this has happened 2 other times. So I guess Monday she called the most pricey plumbers around and they snaked the toilet, camera equipped and all, and sees tampons in the reservoir and blames me and the only other female there in the last 2 months, and tells us were not allowed on the property and we'll not have a check Friday because we'd be paying off the $1500 plumber bill. I've seen like 10 other girls work there in the past 6 months before me. Like how can she just assume something like that?

This is a basement bathroom? That means there are upstairs bathroom(s) that other females use. Hard to prove that it was YOUR tampon that clogged the line.

Take the employer to small claims court to get your pay.

Yes its a basement (office) bathroom which is open for employee use. The owner states she no longer uses feminine products. Still there's been like 10+ female employees that did/do.

@Shangibs6581,
She can't fire you and keep your wages like that, at least she couldn't in Australia and I assume the US has unfair dismissal laws as well. Can you sit down with her and try to discuss this before taking it any further?
You said there had been 10 other girls working there in the last 6 months, I'm wondering why there is such a large staff turnover?

@Shangibs6581,
If you're in anothers' home or employ - Their rules are FINAL.
If Not... Their rules mean Nothing.
