My mother just died and left my daughter as Executor and heir in a will. The will states that my daughter can distribute everything as she sees fit or to keep it all. My mother was also on medicaid. Will there be a state recovery? I am also disabled. Ohio law states there cannot be a recovery if there is a disabled child of any age. But, I was willed absolutely nothing. So, does my daughter have to distribute everything to me in order to stop state recovery or will recovery go on due to the fact that I was not mentioned in the will? Does anyone know how this works? I have no money for an attorney to see if I have any rights.

@JMntg,
Do you live in a "common law" state? Look into your state's inheritance laws.

@JMntg,
Go to Ohio Legal Services and see if you can get a one-time consultation from them about this. Be very well prepared and don't waste time. You might be able to get a low-cost hour but those folks are busy. But this is why they exist.
