These two productions are the subject of much vacuous debate about what is permissible in a denmoracy such as ours.
The plain but not simple answer.
For extreme Anarchist society, it would be consonant for the moral consensus to allow and even favour such libertine behaviour and thought. Limited only by mutual consent rather than force. What this may do to the age of consent is entirely fluid.
For Altruist society based on sensibility rather than sensuality, the moral consensus would be opposed.
For Tyrannies almost anything may suit the Law, according to the requirements of the state or its 'god'.
For anti-society or Chaos, anything and everything would take place to the point at which society itself is destroyed and eventually Nature takes over the remains.
For the first two social conditions the controlling factor is the Moral Consensus, prior to any necessary law.
Why be one or the other, is barely a valid question. There is probably only one logical basis for a particular choice and that is in Altruism providing the most likely basis for human society to continue into the unforeseen future.
