Unemployment eligibility?

My husband lost his job driving a truck due to having an accident. It is unclear if his unemployment will be approved, as it is under review. He has started working for a new company driving part-time so will be looking to claim partial unemployment. If his case is denied from the previous employer, van he file for partial unemployment for working for the new employer? If he is laid off this winter can he then claim unemployment for the new employer?
