I think they did enough differences in The South Butt logo and company name to pull it off.
1. 2 half arches instead of 3;
1.5 Arches are upside down compared to The North Face logo;
2. Black outline instead of read;
3. Different font;
4. Different shade of red for background.

I think that, as a general rule, companies like North Face do themselves a disservice by making a legal issue out of what is plain parody. Most people see that kind of a lack of a sense of humor as just petty whining. As Joe Nation just suggested, am I going to click on that North Face ad at the bottom of this page? Hell, no. I'm pissed at those jerks now.

See what I mean?
