Custody Rights?

If I have sole custody of my child and have been incarcerated for a short period of time ( will get out in 4 months ) and have made arrgement for care, can the mother who has given up her rights to the child , but has visition get cusody of the child?

A "mother" can't just give up rights to her child unless the child is set to be adopted -- by a step mom or someone else.

So I'm thinking that the mother could probably get custody if she wanted it.

That's not necessarily the case, boomer. If we are speaking up the "rights" as between parent and child, it is certainly possible for a parent to consent to the severance of their parental rights, absent a planned stepparent adoption.

But we need more info ... what "rights" did she give up, how did she do so, and what jurisdiction are we talking about?
