okay, we're moving along a little here.

but, let's say that for whatever reason, national conflaguration let's say, that out of the bill of rights, you could only keep one guaranteed right.

what would it be?

Then I'm torn between the 4th and the 9th. But given your hypothetical, I'd have to choose the 9th.

Free speech. I really wish we would have kept that one. Hate speech laws and the behaviour of the citizens (hounding out minority views as seen at a2k for instance ) is proof that we have lost this right.

Butterfly Net has it right. States have all powers not given to the Federal Government explicitly.

However, because of the overuse of the "Commerce Claus' by the Supreme Court, almost anything that crosses state lines can be regulated by the FEDS.

I am heartened by a movement in Montana which proposes to manufacture guns and ammunition to be used only in the state of Montana. This, as I undeerstand it, would preclude firearm regulation by the federal government.
