SHUD CONGRESS CRIMINALIZE PAYING RANSOM to PIRATES on the HIGH SEAS ?

Under Article I, Section 8 of the US Constitution,
Congress has been granted authority to control foreign commerce.

If friends, family or employers of kidnapped victims of piracy pay ransom
to the predators, thay thereby offer financial encouragement
of future additional depredations.

Arguably, people who pay ransom to kidnappers
r actually accessories after the fact.

Shud this be outlawed ?
